Terms and Conditions of Use and Sale

These are the terms and conditions (“Terms and Conditions”) which govern your use of this website (“Web Site”) and which you are required to accept in order to purchase any of the online “The Ritz” gift items. By reading and accepting these Terms and Conditions, you will be automatically transferred to the Web Site and will be bound by these Terms and Conditions. Please read these Terms and Conditions carefully before using the Web Site. If you do not agree to these Terms and Conditions you will not be able to purchase any gifts from the Web Site. We do not sell products through this Web Site to children. By using this Web Site and accepting these Terms and Conditions you confirm that you are at least 18 years of age. The Ritz reserves the right to vary these Terms and Conditions at any time and from time to time. It is your responsibility regularly to review these Terms and Conditions before each purchase to keep up to date with any changes to them.

1. Purchase

1.1 The Web Site offers The Ritz gifts for sale (“Gifts”).

1.2 No contract for the sale of any Gift will subsist between you and The Ritz unless and until The Ritz accepts your order by way of an email detailing that payment has been received in full, identifying the Gift purchased and confirming your details (the “Confirmation”). That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time and on the date The Ritz sends the Confirmation to you (whether or not you actually receive the Confirmation). The Confirmation amounts to an acceptance by The Ritz of your offer to buy Gifts from The Ritz.

1.3 You must check that the details of the Confirmation are correct as soon as possible and you should print out and keep a copy of it. Please inform us immediately if you believe anything is incorrect.

1.4 Payment will be taken by Sage Pay by credit or debit card (Visa, Visa Debit, Visa Electron, Mastercard, American Express, Maestro).

1.5 You undertake that all details you provide to Sage Pay for the purpose of ordering Gifts are correct, that the credit or debit card you are using is your own and that you have sufficient funds to cover the cost of the Gift ordered.

1.6 The Ritz reserves the right to reject any offer to purchase by you at any time without explanation and at our sole discretion. We may not accept your order if, for example but without limitation, (a) an item you have ordered is out of stock, (b) we are unable to obtain authorisation for your payment or (c) we identify a product or pricing error.

1.7 We will try to keep the Web Site as up to date as reasonably possible but do not guarantee that any particular item will always be available. If having accepted an order we find we cannot supply any item we will try to contact you by telephone or email and will be prepared to release funds being held for the purchase but shall have no further or other liabilities in respect of our cancellation of any contract.

1.8 We have taken care with our photography so representations of Gifts are presented as accurately as possible. However, the colour and clarity of each gift will depend on your individual monitor. Therefore, we do not guarantee the colour or clarity of any Gift displayed is accurate. All Gift descriptions and prices are communicated for guidance and present only a general idea. Nothing contained in any Gift description or indication of price will form any part of these Terms and Conditions.

1.9 Prices indicated on the Web Site are indicative only and are subject to change at any time and from time to time without notice. All the prices stated on the Web Site are inclusive of United Kingdom VAT, which will be charged at the rate applicable from time to time, but are exclusive of charges for postage and packaging which will be charged in addition.

2. Dispatch of Gifts

2.1 Gifts will be delivered to UK addresses only.

2.2 Please note that all delivery times are estimates only and delivery is by Royal Mail therefore The Ritz will not be held responsible for any goods lost or damaged in the post or for any postal delays. Please note it is not possible to deliver to PO box numbers as all deliveries will need to be signed for at the time of delivery.

2.3 Queries regarding Gifts where you have been notified of dispatch but of which you have not received delivery must be made within seven (7) working days of the date of acceptance and your order number must be quoted in correspondence.

3. Returns and Refunds

3.1 Subject to this section 3, you may cancel your order within 14 (fourteen) days of the day on which you receive the Gift(s) (“Cooling Off Period”). You must inform the Ritz of your decision to cancel your order by contacting us by telephone or email.

3.2 Provided that the Gift is a returnable item (see 3.3 below) and is returned in perfect condition with the original labels, you will be entitled to a refund of the full sale price and for standard postage charges for sending the Gift to you. Please note that Gifts that are damaged, soiled or returned without their original labels may not be accepted and may be sent back to you.

3.3 The Ritz does not accept returns for: (a) items which are not suitable for return due to health protection or hygiene reasons if unsealed by you (including Bathrobes and Slippers); (b) food products (including Tea, Christmas pudding and Buche du Noel) or products which may deteriorate or expire rapidly; or (c) products which are, after delivery, inseparably mixed with other products.

Please enclose a copy of your original order confirmation within the package under which Gifts are returned. You must bear all of the costs of returning the Gift(s) via trackable postage. After receipt of valid returns, The Ritz will effect refunds back onto the payment card that was originally used for the purchase. Other than in respect of the standard postage in respect of orders sent to you and cancelled during the Cooling Off Period we do not refund postage and/or packaging charges.

3.4 As a consumer you have certain inalienable legal rights in respect of goods that are faulty. Nothing in these Terms and Conditions or any additional terms and conditions applicable to a Gift alter or affect such rights.

4. Liability

4.1 This section 4 applies only to the extent permitted by law. For the avoidance of doubt, The Ritz does not exclude or limit any liability for (a) personal injury or death resulting from The Ritz’s negligence or wilful default, or that of our employees or agents; or (b) fraudulent misrepresentation.

4.2 If we breach our contract with you, we shall not be responsible for anything other than, or in excess of, the sale price of the Gift. The Ritz shall not be liable to pay any other damages or compensation, for losses suffered, or for any indirect or consequential loss.

4.3 Whilst we will endeavour to act with reasonable skill and care, The Ritz gives no other warranty or representation.

5. Copyright

The Web Site is protected by copyright, and other intellectual property rights and laws. You may view the Web Site and download part(s) of it to a personal computer for personal viewing for private purposes, but for no other purpose whatsoever. NONE OF THE CONTENT OF THE WEBS SITE MAY BE DOWNLOADED, COPIED, REPRODUCED, TRANSMITTED, STORED, SOLD OR DISTRIBUTED FOR ANY NON PERSONAL PURPOSE WITHOUT OUR PRIOR WRITTEN CONSENT.

6.1 Your privacy is important to us, and we are committed to maintaining the privacy of any personal information received from you. We will comply with our online privacy policy and the principles of UK Data Protection legislation. By giving us your details you consent to us using them for operational purposes.

7. Disclaimer

By accessing and using the Web Site, or any of the information on it, you acknowledge that, while reasonable endeavours have been used to ensure that all information contained on the Web Site is correct, accurate and up to date, we make no warranties, representations or undertakings that the material on the Web Site will be free from infections, viruses, worms, trojan horses and/or other codes that have contaminating or destructive properties. It is your responsibility to take protective steps such as virus checking.

8. General

We reserve the right to change these Terms and Conditions at any time and from time to time without express notice. Any changes will take effect immediately upon their posting on the Web Site.

9. Governing Law and Jurisdiction

The Web Site and these Terms and Conditions are governed by English law. You agree to submit to the exclusive jurisdiction of the English courts in all matters relating to such use of the Web Site and in relation to these Terms and Conditions. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid you agree that the other provisions of these Terms and Conditions will remain in full force and effect in so far as possible. If you access the Web Site from outside the UK you are responsible for compliance with any local laws relating to access.
